We have a beautiful almost new house for sale. I am sure that we could have sold it a few times, it's beautiful, modern, has 2.5 acres and lots of fruit trees and gardens. Our problem is the property was divided in a really funny way. 1.3 acres is on one side of a creek (where we live), 1.5 acres is on the other side of the creek ( more beautiful with old growth trees, a carpet of Chantrelle mushrooms and if a few trees removed, an ocean view. Problem...we can drive onto the side where we live, but there was supposed to be a road to the other side. The SCRD (the regional district that makes up rules as they go)has left no road allowance to the other side from the highway. Neighbour 1 (the one at the front of our property) says no darn way anyone can use their driveway...fair enough) the other neighbour that our property abutts to says no way as they have tenents that want their privacy and will not allow us to use the panhandle, fair enough). I have asked the SCRD to find a way to get us on to our property, they say "its our problem". Our property is for sale and no one wants to own 1/2 a property and pay for a whole one. People have said that we should build a bridge..sounds good to me. Problem...little or no money for bridge, creek is about 80ft across and about 35-40 ft deep. One side is pretty sheer. It is quite beautiful, we call it Jurassic Creek, it has huge ferns and trees. We are not allowed to cut down trees at the edge of the creek , this would be so easy as there are two tres at least 100' long that would make a nifty bridge. Any unique ideas on bridge building?

As I understand it, divisions are not to be allowed that create land locked land; land that has no access to it.

Your situation might be different since you do have access to your residence but your problem is access to the whole property.

Have you searched all maps and titles to see if there is legal easement or legal access drawn in somewhere, or registered on title, that your neighbours are not fessing up to? You say there was supposed to be a road. Who said there was supposed to be a road? The Regional District? The person who subdivided? The Highways Department? FInd out who said what to whom and what documentation exists to verify.

Would it really be any skin off your neighbour's nose to allow you use of a panhandle? And why does that panhandle exist? If it is there for your use, ain't no one can kick you off. Are you wanting to use this panhandle as access to a second residence? Or simply a way to get onto that part of your property for occasional visits?

The panhandle appeared when the neighbour subdivided his property into 3 pieces. It is right on the edge of our property. Would it be any skin off their nose? Seems to really bother them that we want access. For 7 years we have not really bothered with that side. The one neighbour has used the duck pond and part of the back yard for barbecues for years.
Wish there was a way. The bridge seems to be the only way.
